I have court orders out of San Diego, CA. Our son is 16 years old and there has been an ongoing issue with the mother (primary custodial parent) not following court order. I have legal and joint custody.
Recently the mother has allowed our son to miss multiple days in school and recently disenrolled him from school, denied contact via in person or telephone.
His counselor advised me they moved to Mexico with her parents and current court order states she is not allowed to move out of San Diego County unless I or the court grants permission.
What are my options?
If she has abducted the child, notify the law-enforcement authorities, both federal and state. As to the custody, set a hearing for a request for change of custody and to have the child returned to you and for you to be given sole legal and sole physical custody and the mother to have only monitored visitation.
If your ex has left the country without your consent or court order, you should go to court immediately and get orders for the return of the child. As for school, denial of your timeshare, etc, that strengthens your case for modification of orders.
