I was driving home and had a green light as I approached intersection a suv going west collided with me causing concussion and fractured tibia .there weren't any witnesses but only traffic cams. I hired attorney and asked to subpeanod videos and he says he won't do that. Is my case of recovery credits lost or do I have a chance .should I hired another attorney
ask your attorney how he will prove your case without the video.
If you did not get a satisfactory answer, consult with other attorneys before you hire a new one.
It is possible that the adverse insurance company has already accepted liability causing no need to require the video images. In this event, the only issue in controversy is the amount of your damages. However, if liability has not been accepted, and there are no witnesses, ask your attorney how he plans on establishing liability without the videos. If you do not like his answer, you can switch attorneys at anytime with no affect to your bodily injury claim. Hope this helps.

Well, first of all, unless there is an outstanding criminal court case involved here or an active civil suit, there is no power of subpoena available. Attorneys cannot just throw out subpoenas without some kind of active court case.
You need to sit down with your attorney and go over the reasons he has not subpoenaed the traffic cam video. If there is no active court case, that is your answer. An attorney can request the traffic cam video, and in some cases the jurisdiction will provide them for a fee. However, without an active court case, a subpoena is inappropriate.
