Christmas day of 08, my husband, two children, and I were in a roll over accident. No other cars were involved. The roof of the car collapsed on my husband and five year old son. My husband suffered severe brain trauma and is now in a convalescent hospital. My son suffered a concussion and small abrasion on the head, requiring a couple staples. We had a Ford Explorer Sport. The seatbelt snapped and the airbags did not deploy.
I'm very sorry this tragedy happened to you and your family. The seat belt should never have snapped. I hope someone got pictures of the inside of the car. Did the CHP come and investigate the accident? Has anyone put the rental agency on notice to preserve the seat belt that failed? Do you know what happened to the car? Has it been junked yet?
It is usually best to get representation very soon after the accident, but it may not be too late to preserve the evidence. I have been doing auto accident litigation for over 30 years and if you wish to talk to me and tell me a little more, I will be happy to give you my thoughts. There is no charge for the consultation. You can call me at 415 233-0605, if you wish to do that.
