I am wanting to open a digital magazine soon, I need to know legally what i have to protect and if i have it trademarked and i sell it on the app store or google play do i need to register the name as a company?
I offered a detailed answer on your other post, but of course you should be discussing everything over with legal counsel in private.
DISCLAIMER: this is not intended to be specific legal advice and should not be relied upon as such. No attorney-client relationship is formed with the law firm of Natoli-Lapin, LLC on the basis of this posting.
You need to discuss it with IP counsel. You need to do a search and then trademark the name. You need to have a copyright policy. You need to have agreements with your contributors. You need to have terms of service.
You should consult an IP attorney to make sure you do everything properly or you may risk losing your business and products later. The name may be trademarked. The content can be registered as trademarks. User agreements and be properly drafted and put in place. There could also be trade secret and privacy issues involved. And your magazine should be aware of defamation and advertising related legal issues. You should set a business for liability and tax purposes. Although the company does not have to bear the same name as your brand, it can own the brand as asset. But all of the above are til complex to handle without IP counsel for most.
The answer above is not intended to be legal advice. No attorney-client relationship is intended to be formed by providing the general information. Please consider consulting an attorney licensed to practice in your state for legal advice specific and appropriate to your situation.
See my response to your other, identical question.
The above response is general information ONLY and is not legal advice, does not form an attorney-client relationship, and should NOT be relied upon to take or refrain from taking any action. I am not your attorney. You should seek the advice of competent counsel before taking any action related to your inquiry.
