Recently, I fell asleep at a stops light waiting to turn into my neighbor. Though I was extremely tired, I had a few beer beers over a 4 hour span. An officer tapped on my glass, and immediately I was alert. After questioning me to why I was sleep at the stop light. After explaining my situation, he suggested I do a field sobriety test, at which he told me I failed. I forego other testing and was immediately escorted to jail for a 3rd offense. Hours later they drew my blood. I have a prior state jail felony for poss of a control substance >1 g . I feel as my BAC was under the legal limit, however, it was the previous time and I was charged. What measures should I take, and is this a case that can be reduced?
DWI 3rd or more is a 3rd degree felony, punishable by confinement in prison from 2 to 10 years and a fine of up to $10,000. Probation is possible but days in jail will be a condition of probation if it is granted. As a condition of bond, you must have an interlock device installed on your car while the case is pending, and you also have to deal with the license suspension issue within 15 days from the date of your arrest.
