I was shopping at a retail store when two women that worked at the store came up to me and asked if they could take my clothes. Thinking they were going to start me a changing room I handed the lady the clothing. She then proceeded to ask me to leave the store. Confused, I asked why and she said because they had caught me stealing. They claimed that I was in the store a previous day and had grabbed a bunch of articles and ran. I told them that wasn’t me and they kept accusing me and saying “we remember”. Without any proof or footage they kept accusing me and in turn forcing me to leave the store. Not only was the experience extremely disrespectful and humiliating. It felt like profiling and discrimination because I have an alternative look. I’m wondering what action I can take.
Employees keep costing their company millions. First, if you can show that your race, age, gender or other protected category played a factor in this, then the store would be liable for discrimination under the UNRUH ACT as well as 42 USC Sec 1981. Also, if they wrongly accused you of stealing, that could be defamation per se provided that some other person heard this. More details needed.
