On, 3/6/2017, the OAG determined that the issuance of an order through the child support review process is not appropriate at this time. This does not affect the right of the OAG or any party to request other remedies as provided by law. If you have an existing child support order, it remains in effect until further order by the court.
I am now being sued by The State of Texas, what happened? It is a Suit for Modification of Support Order and Motion to Confirm Support Arrearage. My checks have been garnished for the past 10 years and I am up to date. I'm confused all around. Can someone please help explain what has happened. Thank you!
They probably want to make sure that you have been paying child support and are not in arrears and if you now earn more or less money than you did from the time or your order, they will probably want to adjust your child support to what you are currently earning.
Attorney answers to questions are for general purposes only and do not establish an attorney-client relationship.
You need to respond and then find out what the new issue is. There is a reason they are returning to you. It could also be in error hopefully.
Take the paperwork you were served with to an attorney or purchase a document review session from AVVO - you can select your own attorney or they will find one in your jurisdiction to help you. Let someone help you understand what the new suit is for. Without looking at the papers you were served, it's hard to guess why suit went forward. You need to file an answer to the suit, or hire an attorney to do that for you. Perhaps the other parent did not desire to attempt to reach an agreement, and that is why the review process was not appropriate.
This is answer is not intended to provide you with legal advice, because I'm not aware of all the details of your situation. However, please feel free to contact me to discuss this matter further, and best of luck resolving your family law issue.
