About 30 houses in our Subdivision only 1 has an inground pool....numerous of the owners want the pools WE DO NOT have a Home Owners Association
Are these condo rules or city and county rules? You can request a variance. I'm licensed in California although that's how we do it here. My suggestion: if you can afford a pool then you can afford a lawyer. Hire a lawyer.
You say the subdivision regs prohibit the type of installation you want. If there is no HOA who enforces the regs? I agree with the previous atty. You should consult counsel.
