We have been fighting an eviction because the landlord failed to following the florida tenant and landlord act. The failed to maintain the property and we lost due to default. we missed the day of payment to the courts because it was a holiday and my husband could get his chk on time. what can we do
Do you mean that you received a notice from the sheriff stating you have 24 hours to move? If so they will be back on Monday. The Sheriff will be back so take this time to move your items this weekend.
You lost the case because your lawyer (you) screwed up. The only thing left to do as a practical matter at this point is get your stuff packed and get out within 24 hours - which for evictions is 24 hours not business hours. The Sheriff may well show up at 24.1 hours later and you will need to be gone or you get thrown out physically and all your stuff tossed to the curb.

I agree, you were evicted and lost because you did not pay rent and likely wrongfully withheld it as there is no right to withheld rent in FL for undone repairs. If 24 hour writs are enforced on weekends is up to your county sheriff office, but typically they can be so you should be packing up now expecting them to come tomorrow.
