We received a 30 day notice to vacate the rental on 10/17, we moved out and turned in keys on 10/31. Property management charged for the full month of November and took it out of deposit. Can they charge rent for November if keys were turned in on 10/31, or can they charge you for time from 11/17 to 11/31, which is after the 30 day notice?
Unless you gave the landlord notice that you were leaving and the notice was given at least before 10 October, you are liable for rent for the whole month of November under the WA Residential Landlord-Tenant Act for a month to month tenancy.
If you were a tenant for a specific time with no agreement to convert the tenancy to month to month and the ending date on the rental agreement is 31 October, you did not need to give notice that you were leaving unless you agreed to give notice.
There is no proration of rent in the RLTA except for situations involving domestic violence and the tenant leaving because the rental premises are not up to codes.
Your written rental agreement with the landlord may have provisions that are different than those in the RLTA.
