I lived in the second story of a two story condo over a year, for the past year and just this week, every time it rains a descent amount, there's always a leak coming down from the ac filter area. So I called HOA and they gave the roofing company contact, roofing company said there's no leak to the roof(i think they lie) and has to be the AC. But after AC tech checks it, he said that's no way because it leaks only when it rains so has to be the roof, especially when the AC is not used in the winter. So after talking to the HOA and roofing company, neither of them want to be responsible, what should i do? If i were to find a different roofing company to investigate and they do turn out finding a problem, can i request the hoa to reimburse the cost of finding the company myself? Do i need a demand letter?
Your CC&Rs control who is responsible for repairs to which part of the condominium unit. I suspect that the HOA is responsible whether the source of the leak is the roof or the A/C unit. If the HOA is responsible, write a demand to the HOA to repair the leak and reimburse you for damage to your property. If the HOA refuses, you will then have to file an action in court.
