My rent increase notice came in on 10-29-14 and rent increase is above 10%. I have to let my landlord know by 11-13-14 if we are Going to renew. My current rent is $1052 then taking effect 12-14-2014 amount of $1175. The front office is telling me I can't break my lease early because I'm still liable until 12-13-14. Am I able to break my lease due to them not giving enough notice?
Two wrongs do not make a right. You can vacate the premises at the end of the lease term, but do not have grounds to break the lease. How does anyone know when the rent increase notice was supposed to be sent by your post? The post contains not a clue about when the notice was or is supposed to be made. And at the end of the lease, if not renewed, you are on a month to month tenancy, and depending on how long you have been there, you can be removed after receiving either a 30 day or 60 day notice to quit. If you stop paying your rent, the landlord can serve you with a 3 day notice to pay rent or quit. Following expiration of the notice(s), the landlord an file an unlawful detainer proceeding to evict you.
