I was charged almost 10 years ago with this in KY, I know its a felony. I have since then incurred a few misdemeanor violations. Given the time span can I get the felony charge reduced to a misdemeanor or expunged all together?
It is not an option to have felony reduced to misdemeanor at this time. However, as of 1/1/14 Kentucky state now requires every petition for expungement to include Certificate of Eligibility for Expungement. If you wish to have criminal records (charges/cases) expunged, in whole or part, must complete Expungement Certification process to determine if they are eligible for expungement. See the link below for the online process in Kentucky to begin this process. If it gets too complex or you have questions, consider consult with a local attorney in your jurisdiction with the specifics of matter for rights and options.
Answers to questions are for general purposes only and do not establish an attorney - client relationship. This is general information that is given for legal education only. It may or may not work for your specific situation. It is not legal advice, and I am not your lawyer unless we enter into an Engagement Agreement in writing (and only in jurisdictions that I am licenced - Alaska and Arizona). Consult an attorney in your jurisdiction to determine your rights, responsibilities and the appropriate action(s) you may wish to undertake.
There is no felony conviction statute in KY. You can contact a criminal defense attorney in your area to see what if any, options you have available to you. www.kacdl.net
I am trying to give you a general answer to your question. We do not have an attorney-client relationship by this response on the avvo website. I have not been retained to represent you. I am licensed to practice law in Kentucky and in federal court in this state and the Southern District of Indiana. You need to seek legal advice from an attorney licensed to practice in your area..
