I was suggested from the immigration section to post my query in the divorce section since it relates to the financial affidavit of support as well:
I am currently on H4 visa & undergoing a divorce with my husband who is on H1. I am pursuing a university degree program currently, financially sponsored by my husband. I understand that my H4 status will no longer be valid as soon as my divorce is final.Once the divorce is granted, what happens to the financial affidavit of support that my husband signed and submitted to the university (before we filed for divorce) as my financial sponsor for my full degree program? Can I claim that the remainder of my degree program still be paid off by my husband after the divorce since he had signed my financial support statement earlier?
take a copy of what your husband signed and sent to the university to a lawyer to review. we cannot answer your question without seeing that paper. it may be that he guaranteed the tuition etc for your full four years. if so, maybe the divorce court could undo that, maybe not. we need to see the paper.
make an appointment with a divorce lawyer now who knows something about immigration. bring a copy of that financial affidavit.
