this is in regards to a real estate transaction involving a va loan and collusion between a builder and their preferred lender who attempted to force me to close on a lemon home. A few months prior to real estate transaction I submitted an official request to the military to release me from service. Found out one of the va loan requirements is that you plan to stay on active duty for a year. I then told the bank I had no plans to remain in the military and the bank cancelled the loan, builder said I was in default. 3 months Military ended up not releasing me as planned and thus I am still in the military. Is this considered bank fraud or honest mistake? Can the bank sue me?
I cannot answer this question without reviewing ALL the paperwork involved. The answer to this type of question turns entirely on the documents in my opinion.
