I have a tab with a bar owner. My wife was sent a message to her phone on my behalf stating that if we didn’t pay off our tab that she would take us to court within 7 days. I have no problem paying off my debt. My question is what can she do other than sewing me in a small clams court? I work for rent a center so I know that for us we have legal binding contracts and arbitration agreements with customers that allow us to go after them in court for legal precedings, but with illegal tab information (tabs that were hand written and never actually put into a system) or any legal binding contracts what does this bar owner have?
They have a good common law action against you based upon the tabs you gave run up. It is great to have a contract, but it is not required.
Nothing much else they can do BUT sue you, but if they win, then they have several options to try to collect.

They have a weaker case than Rent-a-center. Pay what you owe, and they may let you drink there again.
