Hire a lawyer ASAP who regularly practices in the local courts. Tell the lawyer that being able to expunge your record is a high priority. The lawyer will need to evaluate whether you have strong defenses to the claim and can then discuss his/her evaluation with you. There are statutory provisions which allow you to avoid a conviction on your record, but those same first-time offender provisions will prevent you from seeking expungment. In some cases, utilizing the provisions of the first-time offender statute is the best option. In other cases, though, your lawyer can work out a deal with the Commonwealth's Attorney so that you do not enter a plea ot the charge, continue the case and then, if you meet certain conditions (such as community service) the charge is dismissed. So long as you did nto plead guilty and are not found guilty, you then have a chance to have the record expunged. *** If you have not informed your parents about the arrest, do so at once.
