The claim must be filed within 30 days of the accident to ensure that your medical bills associated with the accident are covered. The issue is whether you have "serious injury" as defined by the Insurance Law. Consult with a personal injury lawyer asap. You need to serve a Notice Fault insurance claim form with the carrier that insures the Uber within 30 days of the accident in order to get your medical bills and lost wages paid.
