I am in the early stages of my business. However the vineyard has been established. I am beginning the process of getting approval from the town and require a zoning variance. I anticipate resistance from them and I am seeking an Attorney to assist in the process. I have a zoning hearing in Janurary 2016.
You made a smart decision to seek legal representation. It sounds like you have a lot riding on the Zoning Board granting your variance. You should specifically look for an attorney with zoning experience - preferably in the county of the Zoning Board. You can find one right here on Avvo.
Pennsylvania uses two primary statutes to address the problem of local ordinances. The first is the Right-to-Farm law and the second is the Nutrient Management Act. Pennsylvania's Right-to-Farm law contains a provision which addresses the enactment of local ordinances that detrimentally affect the "continuity, development and viability of agricultural operations." The longer the vineyard has been established the better. There will also be many other business considerations. This office offer free consultations on matter such as these.
