my 1 month old BMW was rear ended and fixed for 18K, i traded in the vehicle and lost 5,800 in diminished value. is this an easy win in small claims court in ny? I have court on Tuesday and feel i have all the proof i need, any suggestions?
I can't understand your assessment of diminished value. In general your damages are whatever it takes to make you whole.
It does not sound like you have as much of a slam dunk case as you think. It sounds like you received a bad deal on the trade in. Did you get any other offers, or try to have anyone else purchase the car other than the dealer? How about a quote from autotrader?
Car dealers jobs are to make as much money as possible. It seems that figured out a way to make $5800 from you.

If you traded in the car, it was a negotiation. If you agreed on a price, and the dealership gave you the price, I don't see anything.
