I bank at Wells Fargo and Becu Froze because of fake checks and they are slandering my name when I have $1 to my name until my summer job. I never had $5,000 at any bank so they need to go away and leave me alone because I only have Wells Fargo.
It is possible to sue a bank for defamation of character, but your best bet is probably to prove your innocence to them by presenting the appropriate documentation.
People often use checks to defraud merchants and banks. Banks have an obligation to shut that down as soon as they detect fraud. Your facts stated are very scant and confusing. If you either deposited a forged check into your account, or someone deposited one of your checks with a forgery or non-sufficient funds into another account, the bank needs to take action. The bank is privileged to take such action and privileged statements are not actionable. Further, truth is a defense. Further still, to have defamation, they need to publish or broadcast the false statement to others, a detail you also omitted so far. Freezing an account is not making a statement to others about you. I see no defamation on the facts you provided.
