This is the second time that this has happened and I longer feel safe for my family to use that stove. They keep saying it is ok now but that is the second time that it has happened. I want it replaced. What do I do?
1. Call PG&E. They will come out and inspect the stove. IF it is not safe they will red tag it
2. Contact the SF Dept of Building Inspection. They will come out and cite the landlord if he does not promptly fix or replace the stove.
This is not legal advice and does not create an attorney-client relationship. The information provided is a general statement of the law. Reviewing a case and giving legal advice to a client requires more information than can be exchanged in this format. If you need legal advice, contact an experienced tenants' attorney.
Yes, call DBI, I have their number. To clarify, when they inspect, they will cite the landlord immediately. Then they will do a reinspection a month later to see if it has been repaired the violation. If the landlord fails the reinspection, you could be entitled to withhold rent although you should hire an attorney first to make sure you protected.
