When can I go to court to file a default? I heard it was 30 days and then I herd it was 21 days. I filed for divorce back on Aug 4 2018. But it took the court sheriff process server some time to have her served. I did receive notice in the mail that she was served on Sept 21 2018.
She has 30 days from the time she was served to file a Response. If she doesn't then you can file for a default Judgment.
30 days from the date of service. Since Oct 21 is a Sunday, then you could file it after close of business on the 22 or the earliest possible time on the 23rd of October. Your spouse would have until the close of business on the 22 to file their response and still be timely. You must make sure that the proof of service has been filed, though.
