I have a .75 acre corner property. The survey shows the boundaries of the property that is 5 feet from a city roadway on one side. The city requires a plat to be done prior to any construction or repairs on the property in which they want my surveyors to add a 10 foot easement for utilities and an additional 5 feet for “future road expansion” on the city road side of the property. The road has above ground power lines, sewer and water and leads to farm property that is scheduled to be developed for apartments. Can they require me to put this on my plat? If i do, does that mean i have now given them permission to use it as an easement? It will greatly effect the value and use of my property.
If the property is within the city's jurisdiction, they may have the ability to put in requirements like this when you are applying for building permits. I recommend you hire a local real estate attorney to go over Seguin's specific codes and requirements.
