My buddy got arrested for burglary of a building in Texas. He has a court appointed lawyer and I and wondering what the most likely outcome will be for the plea deal given that he is not able to afford a defense lawyer. He has one other charge pending for marijuana possession. Wondering if it is common to get it pled down to a misdemeanor? I am worried he will have to serve jail time
I do not know the facts of the cases, so giving advice or speculating on outcome is professionally irresponsible. Get the name of the lawyer, make an appointment to discuss the case with the lawyer, and go to the appointment prepared to speak with the lawyer in a hypothetical case. The lawyer cannot discuss you friend's case in particular, but he/she can discuss hypothetical circumstances. The only person in a position to answer your questions, at this time, is THAT lawyer. Hypothetically, burglary of a building can be pled down to criminal trespass, a misdemeanor, and marijuana possession for small amounts of marijuana are already misdemeanors.
