After 7 months of temporary/fulltime employment through temp agency, I was offered full/time Perm employment. I took pre employment drug screen and brought my medicine bottles with but clinic staff was NOT interested. After testing positive I was harassed and threatened to lose my job by the doctor. After being released by the doctor I was approached by my supervisor and the Safety Director and was told that because Adderall caused dizziness and lightheadedness I could be a safety risk on the job. He requested I ask my doctor for something else. I've been on these medications for over 15 years. By the tone at the end of the meeting I am anticipating retaliation or to be "let go". I have had no safety violations or infractions of any kind in the 7 months I have been there. LOST!
You should talk to an employment lawyer in your area. Adderall is a prescription medication, and you may have protection under the American's with Disabilities Act (which would probably cover your employer as long as they have 15 or more employees). I am not familiar with ND law, but sometimes state laws offer similar or greater protection. You don't say what sort of work you do, which would factor into whether you can perform the duties of the job with reasonable accommodation, but the fact that you have worked there for 7 months without this being an issue suggests that their expressed concern about job safety is not based on reality.
