Are there any cases I could research where there was a successful termination of parental rights without an adoption?
The other parent has abandoned child. No physical contact for nearly 3 years despite an order allowing therapeutic contact. No financial support. They are also on parole AND probation for violent crimes, currently have 10 individuals protected by restraining orders (including their other children), etc.
Great question, yes it is possible and yes there is case law to support it. And I hate the question because I was on the losing end of this one (not my parental rights but those of my client), T.P. T.W., 191 Cal.App.4th 1428. The mother's attorney did a brilliant job in this case. I didn't handle the appeal, my friend did and her arguments were excellent as well and are worth reading.
