A friend of ours is going to run for governor in Florida and I offered to help him with his campaign to a minimal extent. A central theme of his campaign is going to be suing the federal government to release Floridians from paying federal taxes except SS & FICA. I've been tasked with finding a lawyer who is an expert in tax law, federal law, and/or these matters to write such proposals, and I suppose handle the legality that would come with this proposal. First, is this even possible to do? Also, what kind of lawyer should I be looking to hire for consultation on this? Thank you. I haven't the slightest clue as to where to begin with such a proposal and I've been staring at this project for the whole weekend. I'm in California but would probably look for someone in Florida
For the sake or argument, I'd say you'd need to look for a Constitutional Lawyer.
Realistically, I'd say this was a wasted effort since your friend is hardly the first person to try to get individuals or states out of Federal income tax. The 16th Amendment allows for income tax collection.
Beyond that, I'd find your friend's campaign promise to be a bit galling: does he mean to suggest that citizens of Florida should get to free ride military protection, payments due military veterans, immigration enforcement, college financial aid, and interest on the national debt to citizens in the other 49 states?
No attorney-client relationship is created by the answers provided here and all answers are of a general nature.
You confess not be a legal person but advise a person who may be running for the governor of one of the most important states in the union. That friend of yours should consult numerous advisers including constitutional lawyers, polticians, etc. Good luck to your friend.
Though it is likely to be quite expensive, and I agree with the other attorneys that there is likely no legal way to accomplish what your friend is proposing, but your best bet would be to consult with a large firm that has teams of both constitutional lawyers and tax lawyers. One of these large law firms would be able to assemble a team made up of lawyers from multiple disciplines to review the goals your friend wants to accomplish, whether they are feasible, and the best ways to go about them. However, the fees for such lawyers are not cheap and this will require significant hours of research and consultations in order to formulate an opinion.
