Our NJ Rules of Court require fee disputes with clients be submitted to the Camden County Fee Arbitration Committee before a suit against the client can be initiated. If you have a written retainer, you will have to submit this together with whatever form the District Fee Arbitration Committee requires to be completed. If the client fails to respond, I believe the procedure is to file a small claims court complaint. If you do not have a signed fee agreement, you are out of luck. All contingent fee matters must be set forth in a written retainer.
