My niece was caught stealing at Sephora. The lpo called police but before that asked her to sign civil demand and trespass note. The police came, took her deets from drivers ID and warned her for future and ask her to leave. The incident happened on 2nd Feb 2018. On 5th Feb she got to know through the mail from stores attorney that they are not filing civil demand note. Whats next?. Is she still in trouble?
Was she ever taken to court and brought before a judge or was she given a pink or yellow piece of paper telling her to appear in court? If not then she was most likely not arrested and she might just have to stay out of the store and keep her nose clean. You should go and talk directly to an attorney who can inquire with the police and the court clerks office to see if there are any pending charges.
The police did not arrest her? That is very unusual. Are you sure she did not receive a Desk Appearance Ticket? I advise my clients not to pay the civil demand because I have never seen a store sue to collect. I write a letter to the store or it’s lawyer directing them not to contact my client and that ends the matter.

The police may have felt sorry for her and not charged her but better make sure she wasn't given an appearance ticket.
