Hello- I have been at my job for 3 years, ( I work at a all center full time) and am looking for information on submitting a claim for worker's comp due to my ENT discovering the beginning of a vocal polyp forming. I have been unable to work for going on 3 weeks, I do not have the vocal endurance I once had and was recommended an appointment with a speech pathologist ( unknown reasons at this point). Can I file a workers comp claim and be successful in receiving those benefits?
Unless you can link your polyp to a condition at work, you probably will not qualify. You may qualify for leave under the Family Medical Leave Act and probably reasonable accommodation under the Americans with Disability Act. You would have to consult with an attorney familiar with these laws through AVVO, your local lawyer referral service or the following two organizations, which are composed of plaintiff-side employment lawyers: www.mwela.org and www.nela.org
