You ask if you will have to set up a Missouri business entity in order to "franchise" your Illinois-based home health agency. The short answer is yes, you must set up a new entity. The longer answer is that setting up a Missouri entity with the same name as your Illinois business does not create a franchise. On the contrary, a franchise is a specific form of organization overseen by the Illinois and Missouri Attorneys General.
