Just received H1b extension till 08/2017. H1b stamping got expired on 10/01/2014. Planning to go to either Alaska, Hawaii or Puerto Rico in last week of Jan 2015 for our marriage anniversary. Can I go with out stamping ? What would I need to carry with me ? My wife on H4.
You can go to either of those three places (Alaska, Hawaii or Puerto Rico) with an expired visa - just be sure not to go on any day trips to another country.
If you do not have a US degree, you have to first check with the respective consulates if they are accepting third country nationals. For what documents to carry - check the respective consular website, take the paperwork that was filed AND speak to your lawyer who filed the H-1B and discuss.
These are risky places to go to. Why? Because if there is a problem with the flight you might get diverted to Canada, a Caribbean island or another country ... making it impossible to return to the US w/o going to your home country for a new visa stamp.
But, if the plane isn't diverted,any of those locations are fine.
Why not stay in the 'lower 48'?
