My husband's(we are separated) new girlfriend put in a CPS report. She is some sort of nurse. She put the report in from some sort of nurse portal. Obviously CPS can not tell me who reported me. But my husband found out and she came clean about it. She accused me of drug use, neglect, and she stated I was mentally unstable. I have been in recovery for 5 years, I have been clean for 5 years. My boys are well taken care of, they have food , clothes , shelter, video games, everything they want or need. I do have mental and physical issues due to abuse from my husband, which is why we are now separated. However, I am getting help from doctors and psychiatrist. I have agoraphobia, PTSD, and personality disorders. My entire world seems to be crashing down due to the CPS case. They are closing the case, because I came out clean on my drug test, and there was no neglect. The new girlfriend has already called CPS again. Is there something that can be done about the false accusations?
Unfortunately, it is very hard to pursue a case against someone making a report of abuse or neglect to the State Central Registry because - generally speaking - the State wants to encourage people to call in suspected reports of abuse or neglect and would rather err on the side of caution when it comes to ensuring the safety and well-being of children. If there becomes a pattern, however, CPS will be able to see that, and it will go into the credibility of the report - though they will still have to conduct an investigation. Best of luck to you!
