He believes and the lawyer thinks that marital property because we bought, but we are both being sued because he is not paying the mortgage and I own the property. And we are losing our marital home because again he got a heloc out and is not paying it or the taxes, so no equity there.
I can see you have some problems here that a lawyer might be able to help you with, but I cannot tell if you are getting a divorce, or just talking about your current spouse. ask a more specific question after providing more facts or go see a family lawyer.
Its hard to understand what you are dealing with but I strongly suggest that you speak with your attorney for guidance, since only your attorney knows the ins and outs of your case better than anyone else.
We need a LOT more facts to give any real answers. You both should contact separate attorney's, especially if this is a divorce situation.
