I am one of 5 children of my mothers estate and one of 3 of my fathers. Both my parents have died. My mother 4 years ago and my father a year ago October. My younger sister is apparently the trustee of the estate which she stated in a text message. I was not informed by any attorney who handled my parents will or trust of the terms of the will. My sisters refused to communicate any information on the estate because they said it was stated in the will that my mothers wishes was I was not to be informed of anything. My sister refused to supply me a copy of the will or trust to this day. However she just sent me a text message asking for my account info because my father verbally asked her to give me 10,000.00 out of the sale of the parents home they owned. I was informed that as an heir I am legally to be informed by the attorney of the death and given a copy of the will or trust terms.This morning my sisters informed me the money will now come from her personal account not the trust account of my parents. I live out of state. The estate is in California. SO how do I get the information I need, lawyer who drafted the will and a copy of the will and trust.
You are ABSOLUTELY entitled to see a copy of the will or trust. Contact an attorney and start by giving them the property address. The deed may show if there was a trust and who the attorney was. The attorney can also write a demand letter to your sister advising her of the law. If all else fails, you can file a Petition in court to get access to the trust.
There is a huge difference between a Will and a Trust. But regardless, if the estate has been closed, you have a huge problem. You will need to hire an attorney on this in CA and seek relief/remedies in a probate court.
