Moved into house with finished basement and it flooded twice landlord wouldn't fix it we did. Mold grew on walls and she will not remove it. We smell it when we come in and it's making my family sick. The landlord wants her money and wants us to leave.

First, the flood and mold issues may constitute a constructive eviction which would relieve you of having to pay rent for the portion of the premises which are rendered uninhabitable as a result of flood. You may also be entitled to offset the cost of the repairs that you made against any rent that is due. In addition, since the mold is presenting a health hazard you may be able to get an order forcing the landlord to take remedial action. In many areas of New York, local ordinances prohibit finished basements and prohibit the occupancy of basements in most instances. You should check your local laws to see if it is even legal to occupy a basement in your area. If it is not legal, or if the landlord lacks the required certificate of occupancy or accessory apartment permit, then you may not be required by law to even pay rent; and your landlord would not prevail in a non-payment action in such a case. Based on your description of your circumstances, I can only suggest that you move out of that place as soon as possible and find an apartment more suitable for human occupancy.
