My husband left 3 years ago to be with another woman. I've been working out of town and due to a problem with some thieving people that were staying on my property, I've placed a property watch. My estranged husband calls the deputies to my home, tells them we are still married and they allowed him to cut my expensive locks off and enter my home and detached garage. Then he replaced my locks with cheap padlocks and I'm away and feeling vulnerable. Shouldn't I have been at least given a call to verify if we in fact were still married? They just took his word lock stock n barrel. He had no reason to do what he did except spite.
Until you file for a divorce and obtain an order granting you exclusive use and possession of the former marital home, you risk continuing to have these problems with your estranged. You should contact a family law attorney to assist you with bringing you marriage to a legal end.
