Paid for a place to rent and it wasn't ready when I was told so after two weeks of it still not being finished I decided not to wait any longer and asked for my money back and she's saying she I charging me a $250 inconvenience fee for canceling can she do this ?
Does the lease specify a move in date? Does the lease have penalties for backing out? Have an attorney review the lease.

Depends on the terms of the deposit receipt for the money you put down (i.e., whether it is refundable or not)., and if you were PROMISED a specific move-in date (neither of which we can't review here on line).
