Divorced with pre-existing settlement agreement and parenting plan. Current plan does not have a requirement for private school.
Probably the Parenting Plan would be my first choice.
Please note that this answer is given for informational purposes only, and in no way creates an attorney-client relationship beteween the questioner and the responding attorney. You should be aware that Mr. Hamman is only licensed to practice law in the State of Arkansas. You are not a client of the Hamman Law Firm until you and Mr. Hamman have both signed a contract setting forth the scope and limitations of the representation, and the reasonable compensation to be paid by you to Mr. Hamman for that representation.
Many facts are missing from your question. Who pays is impacted by both what the plan and the agreement say _ and do not say - about the issue as well as who makes decisions about education. You should take all your papers to an experienced family law attorney and let him or her advise you on this matter.
It would not hurt to address the issue of private school in both, but for sure it should be in the parenting plan where child support obligations are discussed.
