I am a pro se defendant in a unlimited civil case involving breach of contract, trespass, and conversion. The plaintiff is claiming breach of contract involving two horses we paid for in full (as the bills of sale show) she claims we breached by not providing recommended vaccination. She with no court order nor contact came on private property and took the horses. I reported them stolen on numerous websites and by chance they were witnessed wandering around one night and someone who had seen my post contacted us and returned them. She then sued us for the above. The trial has taken almost 3 yrs and about 4months after she filed her case she again trespassed and took the horses. During trial she has lied about horses being paid for (we have reciepts for payments and bill of sale she signed) she provided a bill of sale that was altered very obviously. She has changed her story numerous times on cross exam. When i asked her the same question 3 different times she gave completly different answers. just found out per her testimony she has resold both horses.i was banking on her losing and the judge granting us the horses back but now they are sold.
You need to file a motion with the court asking the court if you can file an additional claim since it arises out of the same nucleus of operative facts.
