Should I plead guilty if I wasn't driving?

The prosecutor must prove beyond a reasonable doubt that you were in actual physical control of your car and not just using it as a shelter (for sleeping). There are a lot of factors that go into this analysis and you should start consulting with attorneys to go over your defenses and prepare to fight.
I highly recommend that you consult with a private criminal defense attorney whom specializes in DUI defense prior to your first court date. There are attorneys here on Avvo (including myself) who offer free consultations. If you hire an attorney prior to the court date you won't have to attend it, the attorney can go forward. If you do go to court prior to meeting with an attorney plead not guilty then consult with one. Best of luck.
