If this is your first offense and you are charged with unlawful possession of Marijuana, what you most likely mean is a marijuana violation. In terms of whether or not you should plead guilty, you should really consider hiring an attorney in your area so they can get a full picture of you and any potential problems that a guilty plea may cause you. (Such as impact on school, work, or immigration consequences). With that being said, you may be eligible for a marijuana acd, which is an adjournment in contemplation of dismissal. What that means is your case would remain open for a year and as long as you don’t get rearrested it would be dismissed and sealed at the end of that year. Your attorney may be able to negotiate a regular acd though, with community service, which would allow an earlier sealing (6 months). Again, it’s tough to say without knowing more about your personal situation. The best course of action for you would be to hire an attorney or if you cannot afford one, to speak with your legal aid attorney.
