I'm having financial problems trying to pay for my three year old medical bills and child care I work two jobs because of this I ask the father to help but get nothing he pays two hundred in child support but never the whole amount when we went to court the first time medical or child care wasn't included I have insurance with my job me and my son are on my plan so money comes out every paycheck
You can file a motion to amend support. You would have to show the court that since the last order was entered there has been a material change of circumstances. If the medical bills are significant and the bills were incurred since then, that may be a material change of circumstances.
IF you convince the Judge that there has been a material change of circumstances, the court will then recalculate support, and in almost all cases, apportion medical expenses between the parties.
On a related note, if he is not current on his support you can file a show cause against him for the arrears.
Any family law attorney should be able to look at your current support order, records of payments, and medical bills and give you a better idea of where you stand.
