My ex and I just recently settled in family court less than 2 months ago. Things have been 'okay' since then excpet for today. When I pick up my son, I usually have someone come with me (but I am not required to). However, today when I went to pick up my son, I was alone. My ex told me & my son that he was not going to let me take him because I was alone & that he was calling the police. I told him that he could but that he was going to make up the time to our son if we had to wait. He told me that he wouldnt make up the time & told both my son & I that he didn't want me anywhere near him. My ex's wife also came up to me in front of my son & was yelling at me saying that they were taking me back to court so that they keep my son away from me. I told them to stop doing this in front of our son & they kept going so I rolled up the windows & started driving down the driveway. When I looked in the rearview mirror, my ex was making a 'gun' with his hand/fingers, 'pointed it at me & jerked it' & then 'pointed it at his temple & jerked it'. I got out of the car & told him to never do that again & he said "Go kill yourself". So I just left. Should I file a police report or call police?
There's not a family court judge in the state who can make the two of you stop acting like children. The "best" case scenario is the judge incarcerating your ex. But there's two problems with that: it's not going to happen on the first violation & it will probably end up make the situation worse.
Maybe you can start doing exchanges at a public place.
You should speak with an attorney to discuss your case, and what your steps can be going forward. Definitely, you need to not allow this to occur again, and to protect yourself in a pick up and drop off situation, and possibly even record the exchanges. Please speak to counsel.
