Should a sales rep who is not an employee be permitted to have a business card with the name of the company they sell for on it?

A sales representative that you may treat as an independent contractor (for tax reasons or otherwise) who carries and uses a business card with your company name may create unsuspecting liability on your company. There is a theory of apparent authority that provides protection to third parties that may deal with your sales person and do not know their "legal status" as an independent contractor because of conditions that you permit to occur.
This situation is complex and no legal opinion can be expressed concerning the outcome of any litigation or planning without a full consideration of the facts and legal research. This answer is given solely as general information and is not a substitute for a legal consultation, nor does it create an attorney-client relationship between you and either the writer or his law firm.
