My ex-husband, constantly in contempt of court, owes more than 20K for non-payment of child support. We have an upcoming court date and my attorney just informed me he wants to settle out of court for under 10k-she advised me to do so.
I've incurred thousands in legal costs and can't afford any more; but, I want what is due pursuant to prior court orders. My attorney evident thinks I don't have a chance of re-couping legal fees.
Do I have options?
Your options are basically accept the offer, reject the offer, or make a counteroffer.
Nobody here will be able to tell you which of those is the best choice; we know nothing about you, the case or your husband. If your attorney is advising you and you don't like the advice, tell him and ask him to explain his reasoning and convince you. If you still are unhappy, find a new lawyer.
