My neighbour pulled his gun and threatened to shoot my son and his friend. His logic was that he was pointing his bb gun at his dog and kids, which is all false. He has been using that bb gun for months and also plays with his kids with that gun. He has also shot that gun numerous times in our and his yard.
He ran the other kid to his house. Then he knocked on our door and threatened to shoot my wife and kids, conveniently when I was not home.
Police was called and they charged him with brandishing a weapon, which I believe is a Class 1 misdemeanor in Virginia.
A court hearing will be done in a couple of weeks I assume. I would like to hire a lawyer and fight this case in court. Could someone please advice me?
I am not sure why you need a lawyer. your case should be prosecuted by the commonwealth attorneys office. you and anyone who else was present can be a witness against your neighbor. theCommonwealth attorney is the attorney who will be representing you.
You don't need a lawyer...unless you were also charged with a crime, which isn't mentioned here. Contact the prosecutor's office. They will be fighting this charge for the state, and if you want to help, they're the people to talk with.
I don't understand your question. You want to "fight" this case? Your family is the victim, right?
If you want to seek a protective order, then a local attorney can help you with that, but that would be a separate civil case.
This forum offers a "quick answer" to a "quick question" but it is not always the best way to consult counsel. The practice of law usually works best (best results) when the lawyer is able to consult with the client, in private, and make a full assessment of all the facts of the case.
If you'd like to consult with an attorney, you can use the "Find A Lawyer" function to look up someone in Charlottesville.
