When i moved out, the landlord mailed me an itemized deduction bill within 21 days and included only a copy of the refund check for the remaining amount. I asked the manager she said to follow-up with the office regarding the real refund check, i left a message few times to no avail. Finally today i tried calling the office again and got a hold of someone who said she will mail it out today. Is this in violation of 21 day policy? Wasnt the real check supposed to be included with the deduction statement?
Yes. The actual check should have been included. You should consider confirming in writing that only a copy of the check was included in the letter, then demand immediate payment, and if it is not provided then file an action in small claims for bad faith retention of the security deposit and request statutory damage damages on top of your deposit under Civil Code 1950.5.
