My brother was put on probation in 2004 for burglary of habitat and he was17 then. While on probation he got in trouble again and they said it was terroristic threat, he had a bibi gun. Anyways he was to possibly get off probation this past November but he had stopped going to probation around April of last year. He had some fines to finish paying, community service, and so his probation did not get revoked for the threat he had to do weekends for a few months but just stopped doing it all. He is trying to take care of it now but what would be the best way to go about it all and get help and would he have to do jail time? We live in tarrant county
There are a lot of factors going on in your question, and you are going to need to speak with an attorney to get specific advice. There is a strong possibility that probation has already filed a Motion to Revoke your brother's probation. If they have, your brother has a warrant out for his arrest. The fact that he stopped reporting is enough to file the Motion, and even if they initially decided not to file the Motion to Revoke when he picked up the Terroristic Threat, his P.O. will probably list that as a factor on the Motion. There is the possiblity that your brother has to end up doing jail time, either as a term and condition of probation if he is continued on community supervision, or serve the rest of his sentence in jail. Without further detail and conversations with the district attorney and your brother's P.O., it is impossible to tell you what is likely to happen. Good luck.
